The BRAM LEGAL Criminal, Sanctioning and Compliance team is composed of a group of lawyers with extensive experience representing clients in complex proceedings, whether of a criminal, administrative, or general sanctioning nature, providing specialized and personalized legal advice.

 

In matters of Criminal Procedure, the team has solid experience covering the representation of individuals and legal persons in a wide range of criminal proceedings, with special emphasis on economic and financial crimes that may determine the criminal liability of legal entities, or the liability of those holding political office.


In the area of administrative proceedings, the team's experience covers all regulated sectors, especially in the areas of banking and capital markets, health and insurance, environment, and telecommunications.


Strictly on the prevention of criminal and general sanctioning and also reputational risks arising from a wide range of economic activities, the core focus of the team is the legal advice in the area of criminal Compliance. This has become a significant part of the team's activity, focusing on personalized treatment for each client and adapting prevention needs to the specific risks of each case. This eminently preventive activity notably includes:

 

  • Creation, implementation, review, and monitoring of Compliance programs within the prevention of criminal and sanction risks;

  • Due diligence in the context of implementing internal control procedures, or in the context of specific transactions or operations;

  • Whistleblowing;

  • Internal investigations;

  • Training of Directors, Compliance Officers, Data Protection Officers, and other employees;

  • Prevention of corruption and money laundering;

  • Protection of personal data;

  • Crisis management;

  • Horizontal legal assessment in the field of information technologies (IT), with prominence on the areas of privacy and personal data protection, copyright and intellectual property protection in the context of software contracts, advertising and marketing, Media and telecommunications, and also in the area of risk prevention within cybersecurity and AI systems (AI Act).
